Q
If I have an accident, should I call the police?
AYes. Police coming to the scene of an accident will take the driver’s and passenger’s information, statements from all parties involved, and the names of any injured parties – all of which is helpful information when a claim is filed.
Q
Do I need a police report to file a personal injury claim?
AA police report is not absolutely necessary to file a personal injury claim, although obtaining a report will significantly help your claim as it substantiates that the accident occurred, how the accident happened, and if anyone was injured in the accident.
Q
How do I obtain a police report?
AAt the scene of the accident, the police will give you an accident/incident slip containing the accident report number, location of the accident, and the precinct number and address where the report can be picked up. The report is usually available within 3-5 days after the accident occurred and should be picked up at the precinct noted on the slip with a $10.00 money order payable to the NYPD.
Q
When should I report the accident to my insurance company?
AAs soon after the accident as possible. However, if you were injured in the accident, it is very important that you only discuss how the accident happened with your insurance company and do not discuss your injuries or any treatments with the insurance company until you speak to an attorney.
Q
How do I know if my injuries qualify for compensation?
AIf you suffered injuries in the accident, seek medical attention immediately. After seeking medical attention, call my office as soon as possible to determine whether or not your injuries can receive compensation. New York State law has various requirements to determine if your case can receive compensation and only an experienced personal injury attorney can advise you properly.
Q
Once your office starts a personal injury claim, how long does it take to resolve it?
AIn most cases, the claim can be settled within 9 months to a year. If, however, a lawsuit has to be started, it may take 2-3 years.
Q
What percentage of claims are settled?
AOur office settles approximately 95 percent of claims we represent.
Q
Will I have to deal with the insurance company once I hire you as my attorney?
ANo, once we file a claim on your behalf, all communications with the insurance company will be done through us.
Q
Does your firm only handle car accident cases?
ANo, in addition to car accident cases, we also handle slips and falls, work related accidents, medical malpractice, and workers compensation cases.
